These Terms of Use (“Terms”) govern your access to and use of the website drmanka.in, the Dr Manka mobile application, and all related online doctor consultation services (collectively, the “Services”) provided by Manka Lifecare Private Limited (“Dr Manka”, “we”, “us”, or “our”), a company incorporated under the Companies Act, 2013, with CIN U86100DL2025PTC454096.

By accessing, browsing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are of legal age and have the capacity to enter into a binding contract.

2. Account Registration

To access certain features (e.g., booking consultations, viewing prescriptions), you must register for an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

3. Services Description

Dr Manka provides a platform to connect users with licensed Indian doctors for online consultations via video, voice, or chat. Consultations are for informational and preliminary purposes only and do not replace in-person medical advice, diagnosis, or treatment.

4. User Conduct

You agree not to:

• Use the Services for any unlawful, harmful, or abusive purpose
• Impersonate any person or misrepresent your affiliation
• Transmit viruses, malware, or harmful code
• Interfere with the Services or attempt unauthorized access
• Harass, threaten, or abuse doctors, staff, or other users

5. Consultation Disclaimer

All consultations are provided by independent, licensed doctors. Dr Manka is not responsible for the medical advice, diagnosis, treatment, or outcome of any consultation. You should seek emergency care or in-person treatment when necessary.

6. Payments & Refunds

Consultation fees are non-refundable except in cases where the consultation could not be completed due to technical issues on our end or doctor unavailability. Refunds, if applicable, will be processed within 7–10 business days.

7. Intellectual Property

All content on the Services (text, graphics, logos, software) is owned by Dr Manka or its licensors and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without permission.

8. Limitation of Liability

To the maximum extent permitted by law, Dr Manka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.

9. Termination

We may suspend or terminate your access to the Services at any time, without notice, for any reason, including violation of these Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
